Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the BabyLingo mobile application ("Application") created and operated by ORBBIS PROMOCAO DE VENDAS LTDA ("Service Provider"), provided as a Freemium service. By downloading, accessing, or using the Application, you agree to these Terms. If you do not agree, please uninstall and discontinue use of the Application immediately.

The Application and all related intellectual property remain the sole property of the Service Provider. Users are granted a limited, non-exclusive, non-transferable license to use the Application for personal, non-commercial purposes. You must not copy, modify, distribute, or create derivative works of the Application, attempt to extract or reverse-engineer its source code, or use the Application for unlawful purposes. All copyrights, trademarks, and intellectual property rights remain with ORBBIS PROMOCAO DE VENDAS LTDA.

The Service Provider reserves the right to modify, suspend, or discontinue the Application, or charge for features, at any time and for any reason. Any applicable charges will be clearly communicated in advance. Continuous availability of the Application is not guaranteed.

BabyLingo Plus is available as an auto-renewing subscription with the following options:

Monthly Plan: $4.99 USD per month

Yearly Plan: $24.99 USD per year (equivalent to $2.08/month, 58% savings)

Payment: Payment will be charged to your Apple ID account at confirmation of purchase.

Auto-Renewal: Your subscription will automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.

Managing Subscriptions: You can manage or cancel your subscription at any time through your Apple ID account settings. Go to Settings > [Your Name] > Subscriptions on your iOS device.

Free Trial: If a free trial is offered, any unused portion of the trial period will be forfeited when you purchase a subscription.

Price Changes: Prices are in US dollars and may vary in other countries. The Service Provider reserves the right to change subscription prices. Price changes will be communicated in advance and will apply to the next billing cycle.

You are responsible for maintaining the security of your device and login credentials, ensuring your device is charged and connected to the internet, and avoiding unauthorized modifications such as jailbreaking or rooting. The Service Provider is not liable for data loss, security issues, or performance problems resulting from such actions.

The Application collects and processes personal data in accordance with the BabyLingo Privacy Policy. By using the Application, you consent to such processing and confirm that the information you provide is accurate and up to date.

The Application integrates third-party services with their own Terms and Conditions, including but not limited to Google Play Services, Google Analytics for Firebase, RevenueCat, OpenAI API (ChatGPT), and Apple Pay. The Service Provider is not responsible for losses or disputes arising from their use.

Some features require an active internet connection. The Service Provider is not responsible for limited functionality due to lack of connection or data exhaustion. You are responsible for any data or roaming charges incurred.

The Service Provider may release updates to improve or modify the Application. You agree to install updates when available. Upon termination, your license ends and you must uninstall the Application.

All trademarks, logos, and content within the Application are protected by intellectual property laws. You may not use the BabyLingo name or brand without written consent from the Service Provider.

The Application is provided "AS IS" and "AS AVAILABLE", without warranties of any kind. The Service Provider does not guarantee uninterrupted or error-free operation. Use of the Application is at your own risk.

The information provided in BabyLingo is based on research from reputable universities and peer-reviewed scientific sources worldwide. All educational content is reviewed and compiled to inform and support parents and caregivers in their learning journey. However, the information provided is for educational purposes only and is not intended to replace professional medical advice, diagnosis, or treatment. Always seek the advice of your physician, pediatrician, or another qualified healthcare provider regarding any questions about your health, pregnancy, or your baby's development. While the Service Provider strives to ensure that the content is accurate and up to date, medical practices and research may vary by region. ORBBIS Promoção de Vendas LTDA assumes no liability for decisions made based on the information provided in BabyLingo. The content is offered "as is" and solely for general informational purposes. Users are encouraged to consult licensed healthcare professionals for personalized medical advice.

To the fullest extent permitted by law, ORBBIS PROMOCAO DE VENDAS LTDA shall not be liable for direct, indirect, incidental, or consequential damages arising from your use or inability to use the Application. This includes loss of data, profits, or opportunities.

The Service Provider may modify these Terms periodically. Updates take effect upon posting within the Application. Continued use after such updates constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of Brazil. Any disputes will be resolved exclusively within Brazilian courts.
